What Is a 55+ Community?
A 55+ community, also called an active adult community, is a neighborhood designed for residents aged 55 and over. These communities focus on a vibrant, low-maintenance lifestyle with amenities built for active adults — resort-style pools, golf courses, pickleball and tennis courts, fitness centers, clubhouses, and a full calendar of social clubs and events.
In San Diego County there are around sixty 55+ communities, offering everything from cozy attached villas to spacious single-family homes. Most are concentrated in North County San Diego, where land was more affordable when these neighborhoods were originally built. How 55+ Communities Work in California
“Age-restricted” housing is legal because of a specific exemption in fair-housing law. Understanding the rules helps you know who can live in one of these homes — and avoids surprises down the road.
The 80/20 rule
Under the federal Housing for Older Persons Act (HOPA), a qualifying 55+ community must have at least one resident aged 55 or older in at least 80% of its occupied homes. That 20% cushion gives communities flexibility — for example, to allow a surviving younger spouse or an inherited home to remain occupied — while keeping the neighborhood’s senior character.
Age-restricted vs. age-qualified
You’ll hear both terms. In practice they describe the same idea: at least one occupant must meet the community’s minimum age (usually 55, occasionally 62). What actually governs a specific community is its recorded CC&Rs (Covenants, Conditions & Restrictions), so the exact rules can vary from one neighborhood to the next.
Can someone under 55 live there?
Often, yes. California’s senior-housing law (Civil Code §51.3) recognizes “qualified permanent residents” — typically a spouse or cohabitant of the qualifying senior regardless of their age, and in many cases a caregiver. So a couple where one partner is 55+ and the other is younger can usually buy and live in the community. Because the details depend on each community’s CC&Rs, always confirm the specific age and occupancy rules before you make an offer — this is one of the first things we check for our clients.

Choosing a 55+ community over a traditional all-age neighborhood offers several advantages:

- A quieter, calmer setting — often gated, generally peaceful, and close to healthcare, dining, and shopping.

Do You Own the Land? ROC vs. Land-Lease Communities
This is one of the most important — and most misunderstood — distinctions in 55+ living, because it changes what you actually own and how you finance it.
In a Resident Owned Community (ROC), you buy both the home and the land beneath it as real property — just like any other house. Most traditionally built San Diego 55+ communities work this way, including Ocean Hills Country Club, Auberge at Del Sur, and Avante at Del Sur.
By contrast, in a land-lease or space-rent community, you buy only the structure — usually a manufactured home — and pay a monthly space rent to the park for the land underneath. Understanding the Costs: HOA Fees, Mello-Roos & Space Rent
Beyond the purchase price, three recurring costs shape your monthly budget in a 55+ community. What they cover — and whether they apply at all — varies by neighborhood.
- HOA dues fund the amenities and, in many communities, exterior maintenance, landscaping, and security. Higher dues often mean more amenities and less for you to maintain.
- Mello-Roos is a special tax found mainly in newer developments, repaying the bonds that funded local infrastructure. Established communities built decades ago usually have none.
- Space rent applies only in land-lease/space-rent parks (see above) — not in the resident-owned communities we represent.
